Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of the Pearl Dental Care website, online patient account features, and related digital services (together, the “Services”). By creating an account, submitting a form, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Pearl Dental Care (“Pearl,” “we,” “us,” or “our”) may update these Terms from time to time. We will indicate the effective date at the top of this page. Continued use after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires additional steps or consent.
Who may use the Services
The Services are intended for individuals who are at least the age of majority where they live. If you use the Services on behalf of another person (for example, a family member), you represent that you are authorized to do so and that you will comply with these Terms on their behalf where applicable.
Accounts and security
When you register for an account, you agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account, unless that activity results from a security failure on our side that we have not remedied in a reasonable period after notice.
Notify us promptly through the contact options on our Contact page if you suspect unauthorized access to your account. We may suspend or disable accounts that appear compromised, fraudulent, or in violation of these Terms.
Appointment requests and communications
Features that allow you to request an appointment, send a message, or share availability are designed to help you connect with our team. A submitted request does not guarantee a specific appointment time, provider, or treatment until our office confirms it with you directly.
You consent to receive communications relating to your requests and care (for example, scheduling messages or follow-up instructions) through the contact methods you provide, in accordance with our Privacy Policy and applicable law.
Acceptable use
You agree not to misuse the Services. For example, you must not attempt to gain unauthorized access to our systems or other users’ accounts, interfere with the proper working of the Services, submit false or misleading information, harvest data without permission, or use the Services in any way that violates law or infringes others’ rights.
We may investigate suspected misuse and cooperate with law enforcement where required.

Limitation of liability
To the fullest extent permitted by law, Pearl and its team members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services or inability to use them, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or the Services is limited to the greater of (a) the amount you paid us for the specific Services giving rise to the claim in the twelve months before the claim, or (b) one hundred U.S. dollars, if you paid nothing for the relevant Services. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Pearl and its personnel from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of others’ rights.
Governing law and disputes
These Terms are governed by the laws of the State in which Pearl’s primary practice location operates, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction require otherwise. Courts in that State have exclusive jurisdiction over disputes arising from these Terms or the Services, unless applicable law requires a different forum.
